Virginia General Assembly 2020<\/strong><\/p>\n\n\n\n

The following are bills related to impaired driving that will become law as soon as the Governor signs off on them. The date they officially become law varies between July 1, 2020 to July 1, 2021. <\/p>\n\n\n\n

SB 439<\/strong><\/a><\/strong><\/p>\n\n\n\n

Provides that in the case of an\nadult offender\u2019s first conviction of driving under the influence when the\noffender\u2019s blood alcohol content was less than 0.15, upon motion of the\noffender, the sole restriction of the offender\u2019s restricted driver\u2019s license shall\nbe the prohibition of the offender from operating any motor vehicle not\nequipped with a functioning, certified ignition interlock system for one year\nwithout any violation of the ignition interlock system requirements. The bill\nprovides that if a person is ineligible to receive a restricted license, a\ncourt may instead authorize such person to use a remote alcohol monitoring\ndevice, refrain from alcohol consumption, and participate in an alcohol safety\naction program; such provisions of the bill shall become effective on July 1,\n2021. The bill provides that tampering with a remote alcohol monitoring\ndevice is a Class 1 misdemeanor. This bill incorporates SB\n154 <\/a>and SB 520.<\/a><\/p>\n\n\n\n

SB 798<\/strong><\/a><\/p>\n\n\n\n

Limits unlawful driving on a highway, specifically, by those\npersons whose license was revoked makes it a Class 1 misdemeanor to drive on a\nsuspended license which will be eligible for administrative revocation of\nlicense, and a Class 6 felony for 3rd<\/sup> offense Drive on Suspended\nlicense to highways. This bill will allow persons with a revoked license to\ndrive on private property that is not designated in Title 46.2 Motor Vehicles\nas a Highway.<\/p>\n\n\n\n

HB 34<\/strong><\/a><\/strong><\/p>\n\n\n\n

Allows a person convicted of a first offense of\nunreasonable refusal to have samples of his breath or blood taken for chemical\ntests to determine the alcohol content of his blood to petition the court 30\ndays after conviction for a restricted driver\u2019s license. The court may, for\ngood cause shown, grant such restricted license for the same purposes as\nallowed for restricted licenses granted after conviction of driving under the\ninfluence if the person installs an ignition interlock system on each motor vehicle\nowned by or registered to the person and enters into and successfully completes\nan alcohol safety action program. The bill provides that such restricted\nlicense shall not permit any person to operate a commercial motor vehicle.<\/p>\n\n\n\n

HB 663<\/strong><\/a><\/strong><\/p>\n\n\n\n

Provides\nthat the venue for the prosecution of a circumvention of the operation of an\nignition interlock system shall be where the offense occurred or the\njurisdiction in which the order prohibiting a person from operating a motor\nvehicle that is not equipped with a functioning ignition interlock system was\nentered.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"
