The proposed language is modeled on\u00a0<a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#Background\"><i>Marsy&#8217;s Law<\/i><\/a>, a type of constitutional bill of rights for crime victims.<sup id=\"cite_ref-text1_1-0\" class=\"reference\"><a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#cite_note-text1-1\">[1]<\/a><\/sup><sup id=\"cite_ref-text2_2-0\" class=\"reference\"><a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#cite_note-text2-2\">[2]<\/a><\/sup><\/p>\n<p>The ballot measure would provide crime victims with specific constitutional rights, including a right to:<sup id=\"cite_ref-text1_1-1\" class=\"reference\"><a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#cite_note-text1-1\">[1]<\/a><\/sup><sup id=\"cite_ref-text2_2-1\" class=\"reference\"><a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#cite_note-text2-2\">[2]<\/a><\/sup><small><\/small><\/p>\n<ul>\n<li><small>be treated with fairness and respect for the victim&#8217;s safety, dignity, and privacy;<\/small><\/li>\n<li><small>proceedings free from unreasonable delay and a prompt and final conclusion of the case;<\/small><\/li>\n<li><small>have the safety of the victim and victim&#8217;s family considered when setting the bail amount and release conditions for the accused;<\/small><\/li>\n<li><small>reasonable and timely notice of public proceedings involving the criminal conduct;<\/small><\/li>\n<li><small>be present at public proceedings involving the criminal conduct;<\/small><\/li>\n<li><small>be heard at proceedings where a right of the victim is implicated, including release, sentencing, and parole proceedings;<\/small><\/li>\n<li><small>receive notice of any pretrial disposition of the case, with the exception of grand jury proceedings;<\/small><\/li>\n<li><small>provide information to be considered before the parole of the offender;<\/small><\/li>\n<li><small>reasonable protection from the accused and those acting on the behalf of the accused;<\/small><\/li>\n<li><small>reasonable notice of the release or escape of the accused;<\/small><\/li>\n<li><small>refuse an interview, deposition or other discovery request made by the accused;<\/small><\/li>\n<li><small>full and timely restitution from the person or entity convicted;<\/small><\/li>\n<li><small>the prompt return of property when no longer needed as evidence;<\/small><\/li>\n<li><small>and confer with the government&#8217;s attorney.<\/small><\/li>\n<\/ul>\n<p>The ballot measure would define\u00a0<i>crime victim<\/i>\u00a0as a person against whom a criminal offense or delinquent act was committed and who was directly harmed by the offense or act.<sup id=\"cite_ref-text1_1-2\" class=\"reference\"><a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#cite_note-text1-1\">[1]<\/a><\/sup><sup id=\"cite_ref-text2_2-2\" class=\"reference\"><a href=\"https:\/\/ballotpedia.org\/Pennsylvania_Marsy%27s_Law_Crime_Victims_Rights_Amendment_(2019)#cite_note-text2-2\">[2]<\/a><\/sup><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Pennsylvania Marsy&#8217;s Law Crime Victims Rights Amendment is on the ballot in Pennsylvania as a legislatively referred constitutional amendment on November 5, 2019.
